George, Sorry to hear about your kat. I know how you feel. Two Friday's ago my car was keyed on the passenger side door, luckily it wasn't the kat. I took the car in to get repainted the Wednesday after it happened, couldn't stand to see it like that. I wish I lived a little closer, I would love to camp out and beat the crap out of these guys... |

Hello all: Here is an update on the latest of my "Kat Abuser Hunting." From my last post, I wrote that I had placed a camera in the complex's garage and ran the cable to my apartment. Last week I stayed up till about 4am every night hoping to catch the person in action, but no luck...until Friday! I got home about 7:00 pm and popped a tape in and hit record. I really wasn't expecting anything to happen, until I saw something about 20 minutes later. Recap: 1. I immediately jumped up and made the 50 yard dash to my car(16-inch Maglight in hand). 2. The guy had walked through a door on the other side of the garage. (By this time, my roommate arrived from another hallway for backup.)
After speaking with my complex's management team, they requested a copy of the videotape, so that they could ask him to move out. For now, I am wondering what is next. Either they guy will stop, or he will be provoked event more. ??? The officer told me that if he does something again, it could be considered retaliation-a felony. The Officer did not tell him that I had a videotape, so I am still going to record at night. Last night was my first night back in the garage since Friday. Luckily nothing happened...lucky for him.

Unbelieveable, you catch the guy in the act and the police will do nothing? The can list him as a suspect??? DUH! Kinda like, the guy that everyone saw shoot someone else, still has the gun in hand, and they call him the "alleged" killer. NO, HE IS THE KILLER! (day in court or not) I'd expect that guy to lay low for a while and will start up again. I'd also expect the damage to be even more this next time because in his warped mind, he is out for revenge now. Good luck in nailing the bastard. |

Does the video show without a doubt this guy vandalizing your car? The same thing happened to a neighbor of mine. He caught someone stealing his stereo. Held them at gun point until the cops arrived. They were arrested and then released and then two nights later his truck was completely trashed. The cops can't do a thing for some reason. The officer unofficially advised my neighbor he should probably have some street justice meated out by someone other than himself and plead ignorance when it is done. This guy needs to learn a lesson. I still think you should hire someone to break some arms and/or legs with a warning that next time he trashes someone car it will be worse. |

Reminds me of the time years ago when I had an armed robbery attempt by someone I knew and the cops would do nothing about. Even though I ended up with 20 stitches in my head. Often, private justice works better then the law. Whats gona happen to him? probabtion and a $500 fine? If he gets hurt, next time he'll think twice. |

Goldrush - Even if his face was on the tape, the officer could not make an on scene arrest unless the officer witnessed the offense in person (with a few exceptions). The reason he told you the guy was a suspect is because he (or the investigator assigned) has to gather all the evidence and present the facts to a magistrate in whats called a "Probable Cause Statement" The judge will then decide if enough evidence exists so that a reasonably prudent person would believe that this suspect committed the offense alleged. If he does believe this, the judge will issue a warrant, and only then can the cops arrest him. The tape, the witness statements and the damage to your car are all evidence to be considered by the magistrate. If the cops put this together in a convincing manner, the warrant should breeze through the system, but every county in Texas works at little different in the time frame for issuing warrants. Television has given the public the idea that all you have to do is call the cops and we will arrest the person on site. Unfortunately, that's not true in this, and most cases. Again, about the only time we can arrest someone on site and without a warrant, is when we (the cops) see the offense occur or if it involves a domestic violence case. Someone still needs a butt whipping here, but as far as the criminal case, this could take some time (weeks) and keep in touch with the investigator assigned to the case so that it doesn't get placed under the "things to do today" stack! And remember, just because he gets arrested, doesn't mean he can't bond out an hour later and do it again. Sorry, I don't make the rules - I just enforce them! ------------------ |

Several years ago I had my car stolen from our employee parking lot while I was out of town on business. I had just finished spending 2 months of my own labor restoring the car several weeks before this. The 19 year old kids tried to pawn off the stereo, amps, speakers, wheels and tires to a body shop of a friend of mine right around the corner from our shop. Needless to say, my friend happen to recognize the parts since I had done all the restoration myself at his facility and questions the young lads as to what the wheels would fit, they revealed the exact car they were off of. My buddy told them they had made a big mistake. While the first kid was interrogated, the rest of his employees held the second kid. The kids finally revealed that the car was going to be sent to Mexico the very next day. My friend promised that if they got the car back, no police would be involved, we just wanted the car back. (My friend previously has done some time for running his own Porsche chop shop, after a wild chase, he did get caught stealing a new Porsche and served several years and learned his lesson and wanted to lead these kids away from crime. Since then he has run a very legitimate custom restoration shop for classic cars.) So he knows the inside story of how these kids operate. Once he convinced the kids to return my car and they showed up about 1 1/2 hour later with the car, he then held out his hand to shake the kids hand for bringing the car back. As the kid shook his hand, my buddy pulled out a 3 pound sledge hammer from his back pocket and wrapped it across the kids forearm, breaking it in 2. The second kid tried to run but the employees caught him before he could reach the door. They then proceeded to take all the cash from the kids, about $300.00, removed the stereo, custom seats, from there mini truck and then told them of his background and to never steal again or the next person they run into may not be as nice as he was and asked them how it felt to be ripped off. He kept his word about not calling the police and sent the kids on there way with a bare truck and some junk wheels from my buddies shop. Now, I personally would not do go to that extreme, but I was glad to get my car back with no damage to it at all. My buddy had my car all back together before I returned home from my business trip and I was very gratefully. Hopefully the kids learned a lesson and might think twice the next time. Unfortunately, sometimes it has to come to this for a lesson to be learned and protect was is yours. ------------------ |
