Scot you're killing me LOL I am crying from LOL. U R crazy! don't forget this weeks episode of "Branded". On a serious note: I emailed the guy early this morning (7am) and asked him to call me at work so we could talk this out. I would call him but he hasn't answered my last phone call; not going to play that game. Excuse my French but if he pi$$es me off (and that takes a lot I am ez-goin') I will go after the $500 and TAKE NO PRISONERS. ------------------ |

Steve.... I just checked with "Scum Ball the Wealthy One" a Los Angeles Chrysler Dealer (and also my brother) and he say given the facts that you describe, you would be more than justified in receiving your whole $500. Scum Ball, who is as low to ground as any other dealer, always refunds back a security deposit if the car is not what it was represented to be. If you want to talk to him about your issues he can be reached at 323-221-2151. Just ask for Scum Ball (Jeff) and you will find him to be most helpful. He just recently sold a yellow 2002 for $35,750 and was one of the first dealers to tell the truth to buying public about the $8,500 rebate on some Prowlers. He is expecting a new candy red one this month and expects to sell it at a "low ball" price. He says that if he appears honest on the Prowlers maybe he can screw everyone on the other Chrysler cars he sells! My offer to run up there and thrash this low life to within an inch of his life still stands! In 1906, when I was about 11 years old, I was almost an Olympic grade karate champion. I practiced "low karate" which is where you kick them in the ----- and then run. Very low indeed. Today, 96 years later, I am still one tough cookie! Get the money or get satisfaction. Give the jerk his choice. If you mention my name he will quake in his boots and probably write the check on the spot. BTW if we keep up this banter you might win a T-shirt or a hat or something and that would be a partial payment on your losses. Get Mr. Alley Cat, Gary, Big Ed, Sassy and Larry Lord to participate and you too will be decked out in the latest POA fashion. Gotta run, as my new Dr. Denton PJ's just arrived, via Fed Ex, from QVC. Steve, Well, this is what my friend said to do. The DMV in CA licenses all auto dealers and will probably find this quite interesting as there is a big push to get these 'Salvage' titled cars off of the roads. There is a reason for the 'totalling' of a vehicle, the fact that even when repaired, the car may not be safe. Hopefully, the DMV will get the Bureau of Automotive Repair and possibly the Dept. of Insurance involved to investigate how and where this car was repaired. He was quite shocked that the dealer was not gift wrapping your money to return it instead of making a stink. A complaint to the DMV can apparently open a big can of worms he may not want. Another suggestion was to contact the Dept of Consumer Affairs, after you file complaint with DMV. ------------------ |

sunbird - that may be true; but then this happens....."the choice is yours, pay 250 as promised or let this escalate". I will contact every agency I can think of and perhaps find an attorney who will handle this as a last resort. Okay gang, here's the email I just sent to the Dealer. After giving him ample opportunity to send back half (250) of my down payment I have decided no more Mr. Nice Guy. I am going after the whole 500. The saga continues.......... *******************start email******* It has become obvious you never intended to send any of my down payment back. Regretfully, I am forced to take the following action after seeking legal advice. I will contact the California DMV and file a claim for the $500.00 against your bond. Steven Hester

Steve, Not to sound negative, but e-mail may not have been the best here. I would have used a registered, certified, return receipt letter (traceable, proof of delivery, etc.) IMHO. My two cents says he acts like the e-mail never came in. ------------------ |

purplecat - ignoring it is his option. I am under no obligation to inform him of my pending action. In other words, if I sent him a certified letter he could ignore that too. I'm simply giving him a chance to do right and stop DMV involvement. I don't see any mail fraud here but I am not an attorney. ------------------ |

Scot - I spoke to SB. He suggested I give the guy one more chance before going to the DMV. Going to the DMV was also the advice of others; I think this is a good course of action. It may take a while but if I stay on top of things perhaps the DMV will pursue this and force him to send me a check. ------------------ |

I agree with Purple Cat. Always send a Certified letter for things like this. It HAS to be signed for. That way you have proof that the letter was delivered. |

I would make a paper copy of this thread and print out all of your emails, if you have to go to court. That way when he denies it you have even more evidence that he is lying. ------------------ |

ed - good idea. Of course I have the carbon from the original check I mailed. I don't think he can deny I sent the down payment. I have a bad feeling about this. I can see this dragging on for months and finally going to court. All over a small amount of money. I will do what it takes; maybe keep someone else from going through this. ------------------ |

Steve, You are doing the right thing. Yes, he told you the car had a salvaged title, were he crossed the line was telling you that it would be easy to clean up the title. THIS SHOULD NEVER HAPPEN! I know I'm yelling but it makes me mad to think how many cars are sold that have had the miles turned back or totals rebuilt or in a flood and the buyer knows nothing of the history of the car. I have bought and sold over 100 cars and can spot most damage, but I've seen some good rebuilt cars. They might be OK, but then again they might not. ------------------ |

wildcat - what bothers me the most is he told me the original owner "forced" the insurance company to total the car because he did not want to drive a car that had been wrecked. The owner told me he DID NOT want the car to be totaled; he wanted to keep it. Stress cracks in the frame are too scary for me. ------------------ |
