Turley on Cohen Plea Deal: Trump Could Be 'Unindicted Co-Conspirator' on Campaign Finance Violation

Law Professor Jonathan Turley reacted to former Trump attorney Michael Cohen pleading guilty to eight charges in federal court in Lower Manhattan, N.Y. Tuesday.

Turley said on "Special Report" that President Donald Trump may end up an "unindicted co-conspirator" in the matter.

Cohen pleaded guilty to five counts of tax evasion, one count of making false statements, one count of making an unlawful corporate contribution and one count of making an excessive campaign contribution.

Turley, of George Washington University in Foggy Bottom, D.C., said that "unless this unidentified candidate is Bernie Sanders, it's going to be bad news" for Team Trump.

"If prosecutors accept what is in this indictment, then the president just became an unindicted co-conspirator," Turley said. "If they believe that's what's in this indictment was true [that] he was directed to make this payment."

Trump reacted to the Cohen news while en route to a campaign rally in Kanawha County, W.Va.

Turley said the Cohen case is "more dangerous" for Trump than the Manafort case.

And lastly if Trump is charged with Campaign violation then Hillary and the Clinton campaign needs to be charged also. I submit that there is more evidence of campaign finance violation there than there is thus far with Trump.

Jarrett: 'Deceptive & Misleading' to Suggest Trump Is 'Unindicted Co-Conspirator' in Cohen's Crimes

Fox News legal analyst and bestselling author Gregg Jarrett said it's "deceptive and misleading" for pundits and lawmakers to suggest President Trump is an "unindicted co-conspirator" in crimes committed by Michael Cohen.

Cohen, Trump’s former personal attorney and confidant, admitted Tuesday to violating federal campaign finance laws in 2016 by arranging hush money payments to adult film star Stormy Daniels and former Playboy model Karen McDougal “at the direction” of then-candidate Trump.

Cohen pleaded guilty to five counts of tax evasion, one count of making false statements to a financial institution, one count of willfully causing an unlawful corporate contribution, and one count of making an excessive campaign contribution.

"If those payments were a crime for Michael Cohen, then why wouldn't they be a crime for Donald Trump?" Cohen's attorney, Lanny Davis, tweeted Tuesday.

On "Fox & Friends" on Wednesday, Jarrett said even if Cohen is telling the truth that Trump directed him to pay off the women, Trump would not have done anything illegal.

He explained that if Trump was behind the payoffs, it would not have been solely to help his chances in the election, but also for personal and commercial reasons.

"As long as there is a secondary or dual purpose, the law says it's not a campaign expense," Jarrett said.

He added that in order to criminalize an illegal campaign contribution, which is normally a civil penalty, prosecutors have to show willful and knowing violation of campaign finance laws.

"The fact that a prosecutor in New York says this was a crime, and, under pressure, Michael Cohen agrees to that, doesn't make it so. It hasn't been litigated. There was no trial, no judge, no jury. So, Lanny Davis' statement is very misleading and deceptive," Jarrett said.

"It's blatantly unfair to somebody to be labeled an 'unindicted co-conspirator.'"

Three prominent election law scholars said there are at least four laws that would prohibit the sort of activities under investigation, whether those laws mention collusion or not. Jarrett's focus on a single word fails to reflect the reach of the criminal code."[10]

Jarrett has said that former FBI Director James Comey may have broken the law by releasing a memo to press wherein Comey recounted a conversation with President Trump where Trump requested that Comey end the investigation into Michael T. Flynn.[12] According to University of Texas School of Law professor Bobby Chesney, Jarrett's assertion is "nonsense".[12] University of Georgia law professor Diane Marie Amann also refuted Jarrett's assertion.[13]
