First off, all are O.K.

First the story then the plight.

My wife and two small baby girls (4 & 3 y.o.) were at a stop light last Saturday when some nut didn't even slow down and plowed right into the back of them. It totalled his car and although it did damage, it was not alot to our car. The cop said that if they weren't in a Mercedes, chances are the kiddos might have been hurt. The guy was scum. He tried to get my wife to just swap insurance cards and leave the scene. My wife said, "No, I'm not giving you my insurance card as you hit me." He also tried to get her to lie about the situation to the cops once they showed up. Anyway, he was ticketed and did provide an insurance card.

The problem is that once I contacted his insurance company on Monday, you guessed it, he had let his policy lapse back in January.

What recourse do I have? I plan on contacting the ticketing sheriff this morning to see if they will issue him a ticket for no insurance since he lied to us and the sheriff but, other then that what else is there? I could sue him but, the moron has nothing and is a 45 y.o. part-time waiter living in an apartment (and his car is totaled).

God, I hate deadbeats. Sorry, just needed to vent this morning.

Hey now, sorry to say that you don't have much you can do at this point. Short from sueing this guy, he probably don't have nothing if he don't even keep insurance, you will be stuck with the repair bill. Luckly, no one was hurt. I would rather have insurance that covered my car and persons. Let each cover their own...........The Law needs a wake-up call.....................

Glad everyone is ok. Here in Ohio, the situation is the same. They buy insurance, get their plates, cancel or do not pay the next premium. The law here also has not teeth.

When I lived in Ohio, the same thing happened to me. While sitting at a red light, I was hit from the rear. The driver and all 3 passengers went through the windshield and fled the scene. The ambulance people chased them down, tackled them and took them to the emergency room. Drunk driver, no drivers license, no insurance, stolen car. That was 1973 and I have just recently started having neck problems that my doc says was from that crash. My advice would be to get a thorough check up as the damage to the spine could have no pain right now, but show up with pain and real problems later on.

Glad to see no one was hurt. If you have full coverage it is no problem. If you don't you still can recover the repairs on your policy if you have uninsured and underinsured, you have to sue your own insurance co for the uninsured to take effect. You can sue the guy which he will not pay. Then have his license revoked for non payment of auto accident. That how it works here in Pa. Good luck

In California what happens is that your own insurance will pay you whatever your policy allows, regardless if the other person is insured or not. Then THEY go after the other party's insurance company or, failing they have no insurance, they go after them personally, and get a judgement filed so that if they ever do get $, the $ owed to the insurance company is still paid, PLUS interest at 10% a year.

Trey, in Ohio YOU make out a state accident report for all accidents. When the other party does not answer or make out their state accident report, the state revokes their license. When they go to renew their plates or driver's license the computer alerts the agents and they do not get a new plate or operator's license. Of course, that doesn't necessarily stop them from driving. Your insurance co. should take care of your damage, no problem.
Thanks God, everyone is okay. It is only a car and a lot of aggravation but you can forget that eventually.

UPDATE- Alls well that ends well.....

Well, I contacted this guy, giving him the benefit of the doubt on his insurance, figuring on the fact maybe he had another insurance policy. Not only did he not but, he proceeded to tell me that his attorney told him there was nothing I could do to him.

Man, talk about push the buttons on the wrong guy. I contacted the sherriffs office and told the cop that story. He proceed to write this guy up for two more tickets and will have his license suspended if he can't provide insurance in court. If he can, then he is liable for the whole ball of wax. Either way, he's skrewed.

Last weekend I took the family out of town for a fun weekend. We stopped by a Mercedes dealer just to look at the new models. What my wife didn't know was that I had ordered her a new bigger E-class loaded with everything and a nice set of low profile tires and 18" wheels. Knowing what colors and tastes she likes made this easier. Car was sitting on showroom floor with a big red bow on top. The salesman was in on the secret and she thought we were just killing time.

She took one look at that car (as if on que) and went, "Wow, some lucky person is going to get that one, it's perfect." The salesman then presented her with the keys as I said, "Hello lucky person....."

VERY cool Trey, if you go to court and he looses, which he will, you can then get a judgement against him that will follow him for life, any time he ever gets $, you get paid, PLUS interest at %10.

Thanks all. I might be nice but, she definitely deserved the car. She's a great wife and even better mother to our two baby girls. Add to that, the fact she has to put up with me....and well, she's a saint.

CJ- funny thing about the hubby remark. Wife calls me that from time to time and the kiddos have picked up on that (ages 4 and 3). It's funny to be walking down an aisle at a supermarket and a 3 year old yells, "Hey hubby, come over here." I just grin, turn 4 shades of red, and tell folks we are from Arkansas.

Trey, I hate to throw a wet blanket on the whole scenario but the guy probably will not show up in court. He doesn't seem to follow the rules on a regular basis. If the damage is within the limit you can take him to small claims court, he probably won't show there, either. You will win by default and then have to try to collect by ruining his credit rating, which is probably already pretty bad. It is a total hassle but that is how the system works. Good luck. The main thing is no one got injured.

If he doesn't show in court that would be cool cause then they would issue warrants for him. This would only compound his problems (and costs) as they would get him one way or another at some point.

Either way, show/no show, I'm a happy camper and yes, the main thing is that no one got hurt. Heaven help him had they.
