Well, I received my 1999 Prowler from the Auto Toy Store in NJ. Short story: Car looks perfect, although I can't drive it out of the neighborhood to give it a more complete check. Why? The dealer apparently does not have a title! So, it cannot be registered. The local NJ police, an attorney, motor vehicle and the State Attorney General are on the case and I've been told this dealer has had issues before. I've also learned that you have to be real careful when buying a car from an out of state third party. In fact, I would strongly suggest asking to have a copy of the title faxed to you before buying. It does not look like I will be driving this anyttime soon, as the court process could take months, or the car could be confiscated and I'm out over 34k. (If you see someone on CNN in a black Prowler trying to flee the cops it might be me!) Warren |

Warren, They shipped your Prowler from N.J to your home state with no title? Do you at least have a temporary tag on her? So the car is in your possession, and you have a paid in full receipt correct? I would try to get a new title issued in your home state saying the original got lost. Possession is 9/10 of the law, and you can show proof of ownership. How can this place stay in business? I would think the state would pull their operating license. Good Luck! Prowler X. I wish I would have known, I pass The Auto Toy Store everyday going to and from work. I would have stopped in and taken pics and gotten information for you. Did you pick up the purple one? or black....Those are the only 2 I have seen there. If you need anyone to stop by and inquire for you let me know.......I would be happy to help and I live about 10-15 min away. Hope it works out quickly!!! |

Thanks for all the replies. As to the questions, they will not apply for a new title because of unknown reasons. I checked with a title agency in NJ and they ran the VIN, but it does not show anything in NJ, so the car was likley last registered in NY where it was sold in an auction. I cannot apply myself for the title here in AZ. It needs to be done on their end, even if I have the paperwork, which I only have copies of since they will not send the original copies, eventhough I've made numerous requests for that paperwork also. All of the agencies I have spoken to, including the local PD detective in NJ said they were aware of problems with this company. My gut feeling is that they are about to get the boom lowered on them. My agreement was to have the car delivered with the paperwork by April 23. I paid about $600.00 extra to rush ship it, so it made it here in time. What a waste of money! Shortly after the sale, they stopped retuning calls and emails. Several times I was told the paperwork was "on the way." I did speak to the owner earlier this week, but he gave me some lame story that the title was "lost." He promised to call me back, but he never did. If he wanted to, he could go through a title company and have a new title in a few days or less. I have an attorney working on the problem in addition to law enforcement and the motor vehicle department enforcement people. I should point out that the advertisement for the car said "Free and clear title." Warren |

It is not that simple to get a replacement title. It is possible but not simple. If it was simple folks could steal cars and get a new title and be set. Hopefully you will get some help and get it straightened out. Make sure you insure the car even if you can't drive it. If it gets stolen you will be out of everything. I would put it someplace that no one would think to look. That way if they tell you that you have to return the car, etc., you can stall while you have an attorney take care of it. If they can find it, they may be able to seize it with a writ of replevin. I just got a car back tonight with a writ. If they can't find it, they can't seize it. Again, good luck. I hope it works out in short order. They should be able to do a computer check and find out who previously owned the car. The local dealer can probably do that for you or even a Carfax. |

Most automobile dealerships finance their inventory using a line of credit commonly referred to as a "floorplan"....Their lender generally holds the titles to the cars as collateral until the dealership sells the car..... At that time the dealer is required to pay off the portion of the loan which was allocated to that particular car in order to get the title released and subsequently transferred to the new owner....Sometimes a "shady" dealer will use your money for as long as he can before paying off his floorplan and obtaining the clear title...Many times when this is occurring the dealership has used the money to meet payroll or other operating expenses and the lender is not even aware that the car has been sold until they do a "wholesale inspection" to verify that the cars are (or are not) still in inventory....This could be what has happened with your title and why they have not been able to provide you with a clear title.....On the other hand, since you have checked the state of NJ and found no record of the car ever having been registered in that state, it could be that the dealership bought the car at auction and got "burned" (car was stolen, no title, etc)and they are unable to get a title to transfer to you... In either case, if you financed the automobile you should get your lender involved in demanding a clear title or refund of any monies paid by you in advance and voiding the sale....I suspect that no lender was involved in your transaction since they normally would have required the title be received by them at the time of payment...... I would highly recommend that you file suit IMMEDIATELY and obtain a judgement and then lien any assets the dealer has....Remember that THE BIG DOG ALWAYS EATS FIRST! Good luck! |

I hate to say this, but (my two cents).........hire a high powered Lawyer and make the payment of HIS fees part of the outcome of this court case. No matter who their lawyer is, he would have an uphill battle fighting this. Just my two cents......... |

Wednesday will be the one month mark since my purchase. The detective I spoke to advised me to wait a little longer before going after them legally. I am not sure what to read into this, but I think I know what he was saying. (: There is also the possibility that the owner could have his dealer license suspended. It just amazing to me that the owner would risk his entire business over a title that could be obtained through a title agency in a few days -- if it could be done. Fortunately, I have all the emails from the salesmen from the get-go promising me the title, or that "it was on the way." It is going to be an interesting week! Warren |

Yes, this kind of killed all the excitement of getting the new Prowler. What a total let down -- but I'll get over it. Without going into any detail, I was a hard-core journalist for many years and there are some very "creative" ways to handle this guy and his business without getting into trouble. Trust me. I'm just glad the Kat appears to be in good mechanical condition although I've only been able to do laps around my neighborhood. |

I can't imagine the grief that you must be feeling over this. Doesn't the Sopranos live in NJ? Just kidding. I used to know a guy in PA that would break his legs for 75.00, but that was alot of years ago. He is probably in jail by now. I have a good friend who bought a used Vette from his local dealership. About 2 weeks later he woke up to NO car. Called the police they said it was repossed. Long story short. I was conviscated by the Sheriff office and transported to Houston due to a questionable vin. He got an lawyer and 3 days later he got his car back. I would sue the pants off of him for the pain and suffering that you have experienced. plus the actually damages. You will need a real barracuda for an attorney. I hope it works out for you soon. Steve |

Quick update. Just received the title. I think it is good. Will find out tomorrow when I FINALLY go to register. To make a long story short, the police detective gave the owner until last Friday to produce the title. It was here yesterday, only 36 days late! Now to make up some lost time!
