simonkhaI bought my new 2001 KAT from McKenna Motors Ponoma, California. When I picked up the car on 2/20/02 it had 21 miles on it. Last Saturday when I took it to Tuttle click Chrysler in Irvine, Ca. for front shocks and front end alignment/inspection the service representative pulled up my "vehicle information plus summary report" it showed that my Kat has been put on "first time" service on 10/27/2000 way before I bought the car. So in other words my warranty already started on 10/27/00 and will expire on 10/27/03, not as I thought 2/20/05. The service rep also told me any new vehicle within 12 months can have a free alignment inspection. Since my Kat's warranty already started on 10/27/00 so it was more than 12 months ago so I couldn't get a free alignment. I called McKenna today (11/18/02) and I talked to the sales manager, Carlos Lopez, and he wrote down all my information and said someone would call me, and we all know that never happens. I waited a couple hours and called McKenna's general manager, Greg Johnson, and talked to him, he said he didn't know what to do. He mentioned that I bought the car under sticker price, and that has nothing to do with the warrant what so ever. This guy didn't seem like he knew what he was talking about and just tried to BS his way through the whole conversation, he told me that this case would take a lot of time, which I don't think is true. He says that he had to call Chrysler to ask about how to deal with this problem. My purchase contract stated that the car was "new" , so I believe that I should have the right to have the full warranty.
My question is if this car has been in service before can it be sold as a "new" car?
I need some help on how to take care of this problem.
ed monahanI would take it back to the dealer that you bought it from and tell them to fix it. When they give you some gruff I would tell them to get the salesman that sold you the car, the sales manager and the service manager all together and write it out for you. If you are not happy with that I would then call the district rep and get it in writing. Start out nice, you can always escalate it. They hate bad press so you can always threaten that much later.

Todd CameronCalifornia DMV law says, regardless of miles. a new car has to have an MSO (Manufacturers Statement of Origin). It also states, the Manufacturers warrenty does not start until said car is titled. They had to have either a title (meaning it is a used car, regardless of miles) or the MSO to register it. If they stated in WRITTING it is a new car, they have to by law purchase you an equivalent factory warrenty at THEIR EXPENSE or LOOSE their DMV license to sell cars. it all boils down to, did you get it in writting. Look at your sales receipt.

JRLTodd is correct.
If your car was purchased and marked on the bill of sale as a new car then you are entitled to a new car warranty, plain and simple.
If they continue to give you aggravation and BS, start by going to the DMV and they will point you in the right direction.

Black Tie 161Our Prowler was considered used as it was titled before us. Even though it only had 200 miles. If you are the first person to take title to the car, it is new and the warrantee started the day you bought it.

KrautSimon, I just recently went through the exact same scenario with the purchase of my Prowler. The car I bought is a '97 and it had 1500 miles on it. It had never been titled and was only used by the owner of the dealership for the purpose of car shows and parades. I am, according to the DMV, the original owner. However, as I would discover later, Chrysler doesn't see it that way.

If you check your owner's manual warranty booklet, it defines the warranty start date on page six. It basically says that the warranty coverage begins the earlier of, when the car is put into service, or when the car is titled. This means that if the car was entered into the service garage computer for anything prior to the sale of the car, the "In-Service" date is established at that point. In your case, that date is 10/27/00. For me it was 9/8/97.

When I purchased the car, I was told that I was buying a new car with full 3yr 36K warranty. I made sure that this was noted on my sales agreement, because I had my doubts about the validity of this statement. If you look at your sales contract, you should have the box marked "includes new car warranty" checked. If this is not the case, you will have a difficult time getting it.

I took the car in for warranty work about a week ago and was told by the service manager that the car was no longer covered by warranty. I then went to discuss the issue with my salesman, who didn't quite know what to do. He subsequently went to discuss it with the owner, who reluctantly agreed to live up to their contract. I think had I not had it in writing, I would have been SOL. They offered to purchase the best Chrysler Pre-Owned Vehicle Plan for me at their cost. The plan is for 3years and 50K miles from date of purchase, and basically includes everything the new car warranty includes. It does, however, have a $50 deductible for each warranty visit. I agreed to accept the plan, because it allows me to get warranty work done at any Chrysler dealership, even though I plan to take the car my selling dealer as long as it is convenient for me. I told them that I was not going to pay the deductible for the work they were doing because I had a contract that said I had full warranty. They were dissed, but agreed this time. My hunch is that I will have this disagreement with them every time the car goes in for warranty work, and I'll cross that bridge when I come to it. But I also suspect that (as someone else pointed out) I have them by the short hairs.

So far, we have had a courteous relationship, and they have treated both me and the car well. We'll see what happens down the road, but at least I do have a warranty package. In my case, I believe I got a great buy on the car and the warranty just iced the deal. I would have bought the car without it, but they don't need to know that.

simonkhaThese couple of weeks I have made many phone calls to the dealers general manager demanding him to fix my "factor warranty." Finally my issue was solved. I advise POA members to check your warranty expiration date.
ed monahanHow did you come out on the deal? Hopefully to your satisfaction. I checked mine, it ran out last spring.
