Keep in mind if you were not at fault you may have some leverage, if you were at fault you may be up the creek. I would not be surprised if the insurance company tries to settle for 18K or less. If they won't budge on that price ask them to find a car that is as close to yours was in a condition yours was in prior to the damage, and you might consider that as settlement. Same number of owners or less, This is a good argument for stated value coverage (which I do not have either) I wish you the best with your situation. If you disagree with the amount of the offer, it is then up to you to substantiate quantum. (to prove your loss/amount of loss) For an insurance adjuster, the more paper in his/her file to support a specific settlement payout, the better. So simply, create a paper presentation of your opinion of value, how you arrived at the amount and documentation to support same. Use a variety of sample ads, from various sources. Average out the kilometers/miles and prices and you should get a good indication of where you should be. Don't just send the highest value vehicles, as it destroys the credibility of your submission. Print out a page like this (link) for American units, use the Canadian data too if it seems to help. Ask them how they arrived at that figure. Like Jan said... it's likely an average of several vehicles. Whatever you get, they should be able to tell you where you can get another one for the payout. If they offer 18K, ask where you can get a comparable one for that. If they can't tell you, you need more.
When I totalled my S-10 Blazer in 99, Farmers gave me a figure. I asked the above questions how they came up with that figure. When they told me that they compared several similar vehicles, I did something they didn't expect, and didn't like. I asked for a copy of their comparison. After looking it over I saw they were clearly lowballing me. One of the vehicles most closely resembling mine was $600 more valuable than they offered. And mine had a NEW transmission and no mechanical problems. When I pointed that out to them, they willingly paid me the higher value. They were later sued in a class action lawsuit for knowingly and intentionally undervalueing cars. Good luck. And let us know what they say, if you don't mind.gleng My 2001 Prowler (11,500 miles) was totaled in March and I had to do the insurance fight as well. They originally gave me an offer of 28,028 and could never give me a direct answer on how they determined that number. ProwlerBobWpg I don't know how different it is in the States, but here in Canada, insurance is structured such that it is your obligation to prove your loss and quantum associated thereto.
