$ 13000 and change, this is without the frame being included, I told the Dealer to take the car apart so the insurance dude could see the frame damage and they did and the frame is cracked. Frame is $7500 and not availible at this time or do they(DC)know when the frames will be available again, if ever. We will find out in a couple of days what the story will be. Some of my businesses are car rentals and we occasionally have autos damaged....the normal rule of thumb is if the damage is more than 66% of the book value, the car is totaled...age of car figures into this also, but I would guess the Kat is history....start shopping for a new one.... |

I thought it was 50%, but I do believe the 66% number,,, another car, well it's either going to be black, silver, blue or Orange. thanks for the info, TUIB |

How could they not total it if they don't know when, if ever, frame parts might be available? Good luck, I hope they total it soon and don't jack you around for months. Mike |

Every insurance company is different company 1 will go up to 100% value of car to fix it company 2 will go up to 80% value of car to fix it company 3 will go up to 60% value of car to fix it. Gary, I don't know about you but I have NO patience in dealing with insurance companies. The waiting really is the hardest part (thanks Tom Petty). Had a '89 Mustang GT stolen and recovered in late '89. The thing was stripped to the bone. The insurance company would not total it. Took 59 days to get it back together and the day I got it back the adjuster told me if he had figured in the rental car bill, he would have totaled the car in the first place. I had 60 day rental car coverage. Just make sure they add it all up. Steve ------------------ |

I talked to Allstate today and asked, what percentage would be a total and their answer is 80%. So, I be waiting by the phone. TIC TOC Maybe I will get a rental, that might put me over the top. |

Well rent something nice, maybe a Ferrari... Will they let you get any of your parts off the car? All those chrome front end pieces? Your grill? Man, that's a bummer if you lose all that. Disclaimer - I don't know the law in your state, and I don't want to be accused of practicing law without a license, but if you can benefit from my experience in 2 prior accidents (one was actually my son in one of my cars), you may want to try these approaches: 1. If the other driver was at fault, they MAY owe you the fair-market value of your lost use (if it's your fault, your own company only owes you what's in your policy, more on the order of $25/day if you carry rental insurance at all). It can easily be argued that the fair market value of your lost use is the $229/day that a Prowler rents for on a multi-day rental. It's been 20 days, 60 more, you're approaching half the cost of the car. 2. DON'T LET THEM TOTAL THE CAR. You are entitled to the cash value of the loss in value of the car. Argue that it went from $50,000 to $100, collect $49,900 and keep the car (so you can SELL THE PARTS TO US). 3. If you are covered for rental/lost use, either from the other driver's liability (unlimited) or your own policy, the clock is ticking every day that they don't settle. Recognize that if you go with number 2. above, the clock stops the day they write the check (although you should negotiate for the day you RECEIVE the check). Hope this helps. - GRROWL |
