What do you think? For open and shut cases, should there be swift justice?

Carlie Brucia’s mother summed up the problem. She said that her daughter’s murderer will eat, sleep, and live longer in appeals for a longer time than her daughter was allowed to even live and she said “I have a problem with that!”.

Here is the solution, called “swift justice”:

Instead of having 2 possible results from a jury (guilty or not guilty), there should be 3 possible results:

(1) not guilty,
(2) guilty beyond a reasonable doubt, and
(3) guilty with no doubt

Those who are found “guilty with no doubt” would NOT be eligible for appeal. (If you are found guilty with no doubt, then why would anyone need an appeal? After all, there is no doubt!!) This will allow swift justice, including a quick implementation of the death penalty.

If implemented properly, this would reduce the number of court cases, by reducing appeals. It would also provide more encouragement for really guilty people to plead guilty instead of taking their chances with the possibility of “swift justice”. This would also make the death penalty punishment more cost-effective than life imprisonment (which it should be!!!). Why should we let those scumbags from the bottom-most part of society get the most court time?

makes sense to me.....

Ed....it has been on the news for a long time.....she was the 14 year old abducted at an ATM machine and found murdered a few days later.....constantly showing the abduction on Fox News....I don't remember what state...the guy has been caught for quite a while, he was late 30s or 40s seems like.....

The dude was found guilty this week on all counts brought against him. His lawyer didn't even make a closing argument because the evidence was so overwhelming. If the guy gets sentenced to death, then he will get appeal after appeal... This is because he was found "guilty beyond a REASONABLE doubt". Because there is always in every case some presumed possibility of doubt, the state allows appeal after appeal. If the state could come to terms that it is possible in many cases to determine that someone is guilty with no doubt whatsoever, then there would be no need for appeals in those cases.

If you look deep into my bleeding heart you will find rage especially about this case that the abduction was caught on video. To me the death penalty is the easy way out. Heck we're all gonna die but waking up every day for the rest of your life in a hell-hole is much worse and a better sentence for scum like this. He would be in fear of being raped or killed every day and some how that just seems right. I also believe that money for food should be paid by the prisoner working at about 25 cents an hour at hard labor. jmo

I never watch FOX so that is why I never saw it. I rarely watch anything other than local news.

Sounds like a good plan. Then we could kill all the women who get abortions and their doctors. I only say this because most conservatives who favor the death penalty are also pro-life.
As for "Swift Justice" lets speed things up by limiting the length of trials to 2 weeks max. No more dragging on the trial for 6 months or longer because you can afford the lawyers. After that long anyone could have reasonable doubts. We should be limiting the time for appeals. If you can't prove your innocence after 2yrs then its time to go. Also, if you have a death penalty then everyone who kills should face it and if you kill more than 1 person it should be mandatory.

Even though I am a "bleeding heart lib" as AC so aptly put it, I agree with you to a point....but you conservatives have made too many mistakes by executing innocent people mostly because of over zealous (trying to make a name for themselves) prosecutors. I believe in the death penalty...BUT DON'T MAKE A MISTAKE. I believe our system is screwed up...its probably the best one in the world, but if we start executing people in 2 weeks, it makes us no better than the Iragis, Saudis, and the rest of the rag heads!

The prisons are full of innocent people. Ask any inmate. 95 % will say they were framed. Kill them all, let God sort em out. Jeff made a good point. Life in prison for a child molestor is a bad life.
The local paper had a story on this case this morning. I am no longer totally in the dark.

I had a Philosophy Professor who described the situation best--for me. He posed the question: "If the person you loved MOST in this world [son, daughter, wife, husband, mother, etc] was killed, what justice would you want bestowed--swift & right--on the perpetrator?"

Conversely, he posed, "if the person you loved most in this world [per above] killed someone else, then what justice would you want bestowed--swift & right--on this same most-loved person?

I believe I read in a book one day,,,,, an eye for an eye.

I call on the Az. State Prison several times per week. These guys don't have it bad here,,,,tv, music, magazines, computers, assistance to get trade training and time to study for a degree. We have one local who was in for murder, got his law degree, and now is a free man. OK, they do have it bad,,,,they have to take a shower with other guys

AC--Pro-choice conservative? I'm impressed. This so-called lib has not forgotten 9/11 or the 19 Saudi terrorists. But supporting the war on terrorism does not mean it should be fought for corporate interests only. So far the only winner has been Haliburton. Its a shame that we use our military to be the worlds policemen when we should use them to protect our own borders.
As for the economy, the only growth I've seen is in the part-time? $7.00/hr job with no health care and 50hr work week. By now the tax cuts Bush started in 2000 should have kicked in and we would have a budget surplus. Instead show me a City,State that isn't in the Red. Who's going to pay for it? Would'nt it be nice if Iraq could chip in? I mean were giving them democracy and helping them form an Islamic government like Iran.

Maybe that is true in the Michigan Industrial rust bucket,,,where many are glad to move to new jobs in better climate areas,, with potential for the future. While I agree everyone should have health insurance,,,,, it's not your 'right' to have your employer provide it to you. Last I heard, many companies are in business still selling health insurance coverage.

I think that is a little strong calling Nixon a "coward" AC.
I agree whole heartedly about chasing down the cowards that were behind 9-11...problem is..none of them are in Irag. We didn't go there chasing terrorists...we went there chasing SO DAMN INSANE....and I am one Liberal who agreed with that decision...but we HAVE taken him out...our job is finished over there...lets get back to getting Bin Laden and the rest of his cronies. Enuff of this political rhetoric...we need to just agree to disagree. That is one of the big problems today...we have waaayyy too much argument and mud slinging from both sides in Washington. But if a Liberal (Clinton) said that the American Flag was red, white, and blue....Mr. Hennity in all of his sarcastic wisdom would say "no you dumba$$, it is blue, red, and white"
