Stepson got a ticket for 92 in a 60, and reckless driving for crossing three lanes to make an exit... they cuffed him and were gonna haul him in. It was over the holidays and he explained he was on his way to see his visiting Mom, and supposed to go on a trip the next day... they let him go but now he's worrying about the consequences.

I don't know anything about TX. Here in KY I think they can take your license for anything over 26mph above the limit(?). But they also sometimes drop charges when you're charged with more than one offense.

Any idea what he might expect as a penalty? This was is the Dallas area, state trooper...

I am always amazed at seeing someone in the far left lane of a freeway zip across 3-4-5 lanes in the blink of an eye to exit at an exit they are too close to rather then just go up to the next one and turn around. This happens alot and sometimes, they are not so lucky as to just get away with a ticket. I have seen some horrible accidents because of this stunt.

State troopers are tough tickets to get out of because they are usually in small towns. It will probably be a stiff fine for the lane thing and a lower rate for speeding. He should be able to just pay the fine(s), they should be listed on the back of the ticket, or he can hire an attorney and pay him alot and still probably have to pay something.

If your son lives out of state, don't think about not paying it unless you are 100% sure he will never enter that state again. Of course, then he'd have to worry about other states possibly seeing the infraction and holding him. I'm just not sure.

If this was in Dallas area and he was stopped by the state trooper he must have been on one of toll-ways which also depends what city he was in as Dallas metro area is made up of few cities(plano,carrollton,farmers branch,Irving,etc) and each city has its own rules ...just call the number on the ticket and they will be able to tell you ..Also few months back the state passed some new laws which has made things a bit harder ...

I don't know about Texas, but in NC, SC, VA & TN (where I run gasoline/propane transports) the local judges have a lot of leeway with traffic violations.

My advice is to find someone who is in the know in that county who can refer you to an attorney who handles a lot of traffic cases IN THAT COUNTY. A lawyer who handles a lot of traffic cases will know how to work the system to get your son's case before the right judge at the right time.

It would be well worth the time & money to get your son a lesser violation. By the way - I'm sure he has learned a valuable lesson.

May work in a big city where tickets are just another cog in the big wheel but, with the DPS and small town judges, I doubt if they would put much credence into someone waltzing in and saying their radar is inaccurate or not calibarated correctly (which is what this amounts to).

Keep in mind too, in small towns, tickets are a huge part of the budget for the town coffers.

I'd vote to either pay up and chalk it up to experience or hire a lawyer and pay him...then chalk it up to experience.

In Texas, going under 26mph, you CAN take defensive driving to get it dismissed. Some courts will MAKE you take the course. Over that is just a big fine. Some will just fine you same as 10mph over if you plead guilty. On the other hand, I was in traffic court one day and one guy was charged with 110 in a 55. The judge made him pay a fine, take defensive driving, and gave him deferred adjudication, so that if, in the following 6 months, he "steered clear" of any infractions, it was dismissed from his record. Generally, if you are out of state, you are given a little tougher time. It really depends on the judge and the local. Dennison and Denton Texas, both north of Dallas, are not good places to get caught. But, unless things in Texas changed recently relating to ticket penalties, I don't think your step-son will lose his license over the ticket. There is also a possibility of getting out of it all together. I had DPS out of town ticket me once. My atty got his work schedule, and set court for when the guy was to be far away. No testimony got that one dismissed. There's lots of tricks good atty's can use.
I haven't read the site listed above yet, but I have an old magazine article on radars and how they work, and how to get out of tickets. Did you know a police radar is inacurate near airports or heavily wooded areas? And virtually worthless in heavy downpours? As I said, it was an old article, but technology hasn't changed how radio waves bounce back.
I'm sure sherriff Randall will chime in here for some info for you. He's from Carrolton I think, so might know what your step-son may face a little better.

Most states now have a reciprocal agreement. If you don't pay the fine, you cannot renew your plates or driver's license the next time it is due. Too many people just ignored tickets on the theory that they were not going back there so the heck with it. I have no clue if Texas has an agreement with the state where your stepson resides.

I hadn't thought of that. Some states also send ticket info to your home state. So, getting the ticket in Texas might be forwarded to where he lives as well.

Has he learned a valuable lesson. Or is he learning that valuable lesson now?
