Trying to fight a ticket which states that I was speeding "Allegedly"... I was really innocent, just picked out of a pack of 12 cars... Trying for a plea agreement, but if the does not work, I will have to enter a guilty with an explanation... I am looking for a silver Kat with low, low, mileage... something in the area of 800 - 4,000 miles... I thought I could use this to prove that I don't drive the Kat all the time and in conjunction with the fact that the speedometer is located in the center of the dash... I was just keeping up with the flow of traffic... Might work if I play my cards right. I hope someone can post or email me a close-up of their odometer reading... just in case I have to use this for my defense... Court date is tomorrow. Thank you for your help! WildBill |

Well I can't help - my dash is black and shows 40,621 miles. I just looked in Pauly's Million Mile post and saw Steve T and C5Frank (now Racer X) both have silvers with low miles. Marty |

The courts would not normally accept this type of photo as evidence without some certifying document, such as an odometer certificate from your dealer. If you don't know this judge very well, then be careful on the thin ice you will be treading. ------------------ |

Thanks guys... No, I am not going to base my defense on this piece of evidence. I also have a very clean record & a few other things I can work off of. It is just in case the plea agreement does not work out. I just thought it would help to show the speedometer location & the fact that "I" don't drive the Kat that much... Marty - Thanks for your help any way... I knew you wouldn't have low milage & even if your Kat was silver. The fact that your speedometer starts at 80 mph with warn numbers & the fact that your needle is actually warped & twisted from the G-Forces you apply on it, would not help my cause at all The extra 22 guages around your steering column for the NOS is a dead giveaway as well... My Kat showed 9000+miles. But, if you have a clean record, you can ask for traffic school. I've heard that you can do traffic some where on the internet. Good luck ------------------ |

WIDDBILL,Forget your idear you will loose. This will work. Always has for me. Go or call the DA's office, tell them you are willing to pay the money (thats all they want anyhow) however you do not want the ticket on your record as a moving violation and ask if they will reduce it to a seatbelt ticket. I've found its better to pay them once than to pay your insurance company forever!!! JMO ------------------ |

Your defense will not work for several reasons: 1) not driving a car alot does not mean you are exempt from following the law. 2) Mileage on anyone's OD is not indicative of anything other then the fact perhaps they purchased the car a week ago (hence the low mileage). Here are some tips that may work for you in your state: 1) Request a trial by jury (most judges don't like this because they tend to be sympathetic with the driver who is one of them) 2) Review the ticket very carefully. Is everything 100% correct (ie. your name spelling, type of car, amount of doors, etc.) I once got out of a ticket were the cop mispelled my name and said the Toyota 4-Runner I was driving was a 2-door (it was a 5-door including the hatchback). I asked her to tell the court if she ever made mistakes while ticketing people for speeding and her reply was no. I pleaded that if she could make a mistake from copying info from my license to the amount of doors, possibly she did make a mistake with the radara gun. 3) Ask them when they last calibrated the gun. There are web sites that show that using a gun that is slightly off will show that a tree is doing 5-7 mph. 4) Request defered adjudication. This means if you don't get another ticket within 90-120 days, this ticket is removed from your record (you still pay the fine) 5) Request defensive driving. Onaprwl has the best idea. Take care of it before you ever hit the courtroom. In Illinois we ask for "Supervision" which means if you have a clean record to start with - they'll give you 60 days in which you can't get another ticket. If you do - both tickets count. If you don't - your speeding ticket goes away. It costs you a little more because of "court costs", but as someone said, you won't be paying the insurance company forever and if you do get another ticket, it'll look like your first. |

To the members who posted above, I am writing on the behalf of "WildBill" since he will have no access to a computer from his current location. My firm and I will be representing him for his appeal of his ongoing battle of his, in fact alleged, speeding ticket as well as defending him for his alleged Assault and Battery charges he obtained at his appearence in court last night. William allegedly assulted a courtroom employee, a Judge and two State Troopers from the State of New Jersey. William's arraignment hearing is scheduled for Monday of next week and hopes to post bail by later that same week. I assure you his actions were in self-defense and we feel confident that his charges will be reduced. William asks for your forgiveness in the fact that even though he was acting in his own emotions during this unfortunate situation, he feels that he did not represent the image and ideas of the Prowler Owners Association or it's members. For that he is deeply sorry and humbled. He also asks for your thoughts & prayers. I will not lie to you. This will be a tough case and William will in fact see a lengthy jail time, but reduced from the potential threat that it is now. Larry Salzman (A.K.A AlleyCat) you will be subpoena for a your testimony and your comments have been noted & entered into evidence for recommending to my client to offer a bribe to the Judge of the Municipal Court of North Warren County at Hope New Jersey. What were you thinking? Marty Usher - You will also be subpoenaed in conjunction with your actions in recommending my client, to offer to take the Judge's daughter for a "Joyride" in his Silver 2000 Plymouth Prowler. This was bad advice due to the fact that the judge's daughter met her unfortunate demise early last year due to a horrific high speed accident caused by a negligent driver who was estimated to have reached speeds of, and exceeding, 108mph. Hence forth, the reason why Judge Randall U. Kidding is known for reprimanding speed violators to the fullest extent of the law. WildBill appreciates all of your help during this trying time. He again apologizes to each and every member of the Prowler Owners Association and every to Prowler owner there is for his thoughtless actions. He also thanks everyone who did, in fact post, recommendations for his benefit for his prior court case for his alleged speeding ticket. As his, professional defense lawyer & his representative, I ask you to please seize from any further recommendations in the future and let my firm and myself do our job. Some of your recommendations were actually good advice. William just utilized all of them. WildBill also wanted me to personally apologize to a gentleman that goes by the POA screen name of Fixuum, due to the fact that we probably lost him at the sentence starting with... Bubba says hello in the weirdest kind of ways... Especially to you Ed??? Is there something we should know about??? Would explain a lot... Well had my day in court... I pulled into town & found my way to the Municipal building where the case was being held & noticed on the sign that the town slogan was "The Land of Make Believe"... Ohhhhh $hit... "Do I smell Bubba?" I used the help of a Bactor Delegate from a local township PD who spoke with the State Trooper that was so kind to pull me over... The officer informed my BD, that he was going to try to bring it down to zero points, but was doubtful since this Judge is in fact a stickler for nailing speeders. He said any other Judge in any other county would be cakewalk, but not this guy. It will be tough to get it down to two... Before my hearing, I went in & spoke with the prosecuting attorney. Even though the officer did not show, I was able to get an agreement to bring my fine down to two points. He was a really big Pric& too... Someone you woukld just want to smack around... Some of the officers would just sit their & look at him, eyes opened wide & shake their heads... At this point, if the Judge lives up to his representation than I figured that this would be the best I could do. He also told me that he was filling in for the usual Prosecuting Attorney... Great I got the nice guy... He also informed me that if I was only 1mph faster, that this Judge would have yanked my license away from me... There was someone there who only went 15 mph over & had an Attorney... Being that I was written up for 24 over (allegedly) I was, to say the least, a little concerned... Bubba! HERE I COME!!!! Please be gentle! I observed the cases before mine looking for any opportunities to help me out. One kid went up & pleaded with the judge not to hit him with the two points he was to receive & explained that he would lose his job, his car & would not be let into the Navy... His life would be over... The Judge, who was very stern & rigged did not care & went off on this guy in the courtroom... the Judge turned redder then hell & I could have sworn that I saw horns protrude out of his head as he peered out over his glasses... Gavel comes down as he reads the fine, kid's life is over & pretty evident due to his & his Dad's expression... Guess who was next??? "Yes, Your Honor & good evening!" His head shot up quick... I was very professional the whole time... He O.K.'d the deduction to two points then he asked as he did everyone else... "Is there anything you would like me to consider before I decide your fine? Time to shine... Told him about my Pristine 14+ driving record, & mentioned that I am totally aware of my speed at all times... I also explained that the Vehicle that I was operating at that time is exotic & does attract attention. I explained that at that moment, 12 other vehicles were in my vicinity & with the location of the speedometer in the center of the dash. I was more concerned with my surroundings than I was to look down at the dash for even an instant. Brought up about reaction time & breaking distances... Also mentioned that the vehicle is garaged four months out of the year & only sees the nicest of days. I went on to explain that at the time of the incident, I only had 4,000 miles on the vehicle since I bought her brand new in 2000, which averaged out that I only drive her 2,000 miles per year... An average owner will drive an average car 10,000/year... He looked at the ticket & said... "Plymouth Prowler?"... "Yes your Honor"... "Prize possession?" ..."Most definitely your Honor"... "You have got to slow down Bill, you can't get too wild out there" (...WILD... Does he read the board?) He went on to use the deer jumping out in front of me at that kind of speed analogy... I'm thinking... deer at that speed in any vehicle... Gavel comes down - $170... Much better then $400 + court fees... Drove home doing the speed limit that night... Hour & a half drive too... Glad to get out of "The Land of Make Belive" Was so tempted to ask him if we could make believe the whole thing never happened... But after he dry-docked the Navy boy, did not think it was that funny... Thank you again to everybody for all of your help! I should be able to take the defensive driving class to take care of the rest... Ed I have Bubba's address too... Mentioned something about your "By-weekly conjugal visit" ... Does Nancy know?
