I was looking on eBay today and came across something that caught me off gaurd. Someone had taken a picture of my car and posted it as there's for sale on eBay here . No, it's not my car, but they are using one of my pictures to sell there's. My girlfriend was pissed but it doesn't really bother me all that much. I wanted to post here to find out how some of you would react if this happened to you.

Bill, I'd be honored too. Guess, they are trying to show the red prowler as the best they can, I know your cat is sweeet!! I hope they gave you credit or at least marked it as "file photo". I'll go check it out now. |

I don't think I would like it much. I would have preferred that the person would try to obtain permission. My second thought is if he owns a Prowler, why doesn't he have any pictures? I'd be willing to bet there aren't many owners who don't have pictures. So, why wouldn't he just use one of his own? Beyond that, however, I would think that person would be careful as far as misrepresenting the car he is selling. If a bidder was trying to buy the car based on the appearance and the real car doesn't look that good, the guy could have a problem on his hands. A lot of Dealers use pictures of cars that is not exactly the car that they are trying to sell, but a private person is doing it is sorta a different story, I think I would be honored. JMO |

I am honored but at the same time confused. I was just telling my girlfriend earlier about how weird stuff like this happens to me all the time. She wants me to go after the person. She is really upset because this is my personal property and not for use of someone's advertising. I wouldn't have a problem at all if the person simply stated that the image was not of the actual car for auction. My Instinct is... so they have a camera to take a picture of YOUR kat and not theirs, hmmmm, sounds like they are trying to scam someone out of Kat $ buy selling a non existant vehicle. ------------------ |

Buying a car on Ebay would really be freaky! I have noticed plenty of Vipers and Prowlers with inflated bids. I hope whomever buys that Prowler is told before pick up or delivery what their car really looks like! |

Hopefully it was simply a case of them not having access to a digital camera and it was easy to use an image of your cat off the internet. However, they should have at least asked. At a car show a couple of weks ago I came back from walking through the parking lot looking at other vehicles and saw a note on my black 2000 that someone had used my car as a backdrop for a photo shoot for a calandar. They left their phone number and said to call if I did not want my car used. (They came by later and I told them it was OK, but thanked them for asking.) Happy Prowling Marty ------------------ |

Dan Pena: If you don't like them using YOUR pictures, YOU have the LEGAL RIGHT to tell them they can NOT use it. If they didn't take the picture, and they are told by the owner NOT to use the picture, they MUST take it down without any question. The web is NOT open to anyone. It's a copyright infringement if they use your pictures without permission. If you are in the pictures you can also claim a "model infringement", which has been fought and achived in many courtrooms through litigation. Oddly enough, if you are on someones home video and you say to the person that recorded the video that they cant use the video because you are in it, they have to dispose of it as well. Well I politely emailed the person to remove the image with the following: You are currently using an image of my personal Prowler in your auction. I am sending you this email to ask you to remove it from your auction. I find this may be misleading to potential bidders if they are interested in the auto and they think that this is the actual vehicle. If you do not have any images of the red Prowler being auctioned, I would suggest using a stock image of a red Prowler. If it is not removed, I will contact eBay regarding the matter. And here is the response I got: OK buddy, relax a little! Its only a car and I will remove your unique photo and replace it with my own that I was waiting to take. After I sent the seller a persuasive email concerning the unauthorized use of copyrighted images for marketing purposes, the seller has closed the auction early due to "an error in the listing". And from the illiterate response I received back, I am starting to doubt the ligitimacy of the seller actually owning a Prowler.
